Your right to compensation
Under the Civil Wrongs Law (Cap. 148), any person who causes damage through a breach of their duty of care and negligence bears civil liability to compensate for the resulting loss.
At KP Legal, we provide specialised guidance from the day of the accident through to the final recovery of your compensation. We handle both out-of-court negotiations with insurance companies and court representation.
Claims we handle
Road traffic accidents
Representation of drivers, passengers, pedestrians and motorcyclists.
Workplace accidents
Employer liability and breach of statutory health and safety duties in the workplace.
Public & private liability
Slips, trips and falls caused by poor maintenance of buildings, infrastructure or the road network.
Total loss vehicle claims
Securing the actual market value of your vehicle against the low valuations insurers often offer.
What compensation are you entitled to?
Cyprus law provides for specific categories of compensation, which we claim on your behalf:
Special damages
All actual out-of-pocket expenses caused by the accident — medical consultations, hospitalisation, medication, surgery, physiotherapy, and the cost of medical and police reports.
General damages
Compensation for pain, suffering, loss of amenity, mental anguish and any permanent injury, disfigurement or disability.
Loss of earnings
Lost wages during sick leave, and loss of future earning capacity.
Statutory interest
Securing the award of legal interest on both general and special damages.
Contributory negligence
Can you still be compensated if you are partly at fault?
Yes. Under Section 57 of the Civil Wrongs Law, the fact that you may share part of the blame (for example, not wearing a seatbelt or helmet) does not defeat your claim.
The Court assesses the total value of the damage and reduces the final award strictly in proportion to your share of fault. Our aim is to counter unjustified attempts by insurers to shift disproportionate liability onto the victim.
